1. Definitions
"Book Tailor" or "Company" refers to Book Tailor, Inc., located at 1111B S Governors Ave STE 26192, Dover, Delaware 19904.
"Parent Company" refers to Book Tailor's parent entity and its affiliates.
"We," "our," or "us" refers to both Book Tailor and its Parent Company.
"Service" refers to the website (booktailor.com), its functionality, and the book creation engine.
"Product" refers to any custom book purchased through the Service.
"Content" refers to any text, images, or other materials generated through the Service.
"Input" refers to any information, text, or data provided by users during the book creation process.
2. Acceptance of Terms
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").
If you do not agree to these Terms, you must immediately discontinue use of the Service.
Nothing in these Terms is intended to limit or exclude any mandatory rights or protections that may apply to you under applicable consumer or data protection laws.
3. Nature of Content
3.1 The Service produces satirical and fictional content.
All Content generated through the Service is intended for entertainment purposes only.
3.2 Users acknowledge and agree that:
- Content may be fictional, exaggerated, or satirical in nature
- Content is not intended to harm, defame, or cause damage to any individual or entity
- Neither Book Tailor nor its Parent Company makes any representations regarding the accuracy, completeness, or truthfulness of the Content
- The Content and resulting Product are intended for private, non-commercial use only. Users may not reproduce, republish, sell, or commercially distribute the Content or Product in any format without our prior written consent.
4. Intellectual Property Rights
4.1 Proprietary Rights
- The Service, including its underlying technology, algorithms, software, and all related intellectual property rights, is owned by the Parent Company and licensed to Book Tailor.
- Any attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the Service is strictly prohibited.
- The design, layout, look, appearance, graphics, and user interface of the Service are protected by intellectual property rights and may not be copied or imitated, in whole or in part.
4.2 User Input and Generated Content
- Users retain ownership of their Input.
- Users grant both Book Tailor and its Parent Company a worldwide, non-exclusive, royalty-free licence to use, modify, and process their Input solely for the purpose of providing the Service and producing the purchased Product.
- Users represent and warrant that they have all necessary rights to provide the Input and that such Input does not infringe any third-party rights, including copyright, trademark, privacy, or publicity rights.
- The Content generated through the Service is licensed, not sold, to users for personal, non-commercial use as part of the purchased Product, subject to these Terms.
5. Prohibited Uses
5.1 Prohibited Activities
- Attempting to reverse engineer, decompile, or discover the underlying algorithms or technology of the Service
- Creating derivative works based on the Service or its technology
- Using Input to manipulate the Service into producing harmful, unlawful, or prohibited Content.
- Using the Service to generate content that promotes hate speech, discrimination, or illegal activities
- Copying, imitating, or replicating the Service's functionality or business model
- Using automated systems, scraping, bots, or scripts to interact with the Service
5.2 Input Restrictions
Users shall not provide Input that:
- Is designed to exploit or disrupt the Service
- Violates these Terms or applicable law
- Is misleading, harmful, defamatory, unlawful, or infringing
- Could reasonably expose Book Tailor, its Parent Company, or other users to legal or reputational risk
6. User Accounts and Data
6.1 Account Creation
- Accounts are automatically created upon purchase
- Users must provide accurate and complete information
- Users are responsible for maintaining the confidentiality of their account credentials
6.2 Data Retention
- Unfinished or abandoned book creation projects will be automatically saved for up to 120 days from last interaction
- Completed purchases and associated book creation data will be retained for 24 months from the date of purchase
- We reserve the right to delete inactive accounts and associated data, subject to applicable legal obligations.
6.3 Pre-Purchase Reminder Emails
By providing your email address during the book creation process, you consent to receive service-related communications, including reminders to complete your book project. These communications are necessary to provide the Service. You may opt out of non-essential reminders at any time, but essential transactional messages (such as order confirmations or delivery updates) may still be sent.
6.4 Marketing Communications
Where permitted by applicable law, we may use saved email addresses to send communications related to our products and services, including updates, recommendations, promotions, discounts, and related announcements.
Users may opt out of such communications at any time using the unsubscribe link provided or by contacting us directly. Opting out will not affect essential service-related or transactional communications.
7. Payment and Refunds
7.1 Payment Processing
- All payments are processed through Stripe or other authorised payment processors
- We do not store credit card information
- All applicable taxes, duties, or fees may be added to the final purchase price where required.
7.2 Refund Policy for Custom Products
- Returns and refunds are subject to our Returns and Refund Policy, available on the Service. Custom-made products are generally non-refundable once production begins, except where required by law or stated in that policy.
- In the event of any conflict between these Terms and the Returns and Refund Policy, the Returns and Refund Policy will govern with respect to refunds and returns.
8. Marketing and Analytics
8.1 Tracking and Analytics
- Social media advertising platforms (including but not limited to Facebook, TikTok, Snapchat, and other advertising platforms)
- Google Analytics
- Marketing pixels and tracking tools
8.2 Consent and Choice
Where required by law, tracking technologies will be used only with appropriate notice and user choice.
Users may manage cookie preferences through available settings or browser controls.
9. Limitation of Liability
9.1 Disclaimer
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any damages arising from the use or inability to use the Service
- Any damages arising from the Content generated through the Service
9.2 Liability That Cannot Be Excluded
Nothing in these Terms limits liability in any way that is not permitted under applicable law, including liability for fraud, intentional misconduct, or violations of mandatory consumer protections.
9.3 Liability Cap
To the extent permitted by law, total liability for any claims arising under these Terms shall be limited to the amount paid by the user for the Service in the twelve months preceding the claim.
